Billy Dean's Nassau County Supreme Court Motion Withdrawn

North Bellmore strip club to press on with appeal at Appellate Division.

A motion in Nassau County Supreme Court attempting to have a judge reverse his May decision upholding the Town of Hempstead zoning board’s rejection for North Bellmore strip club owner Billy Dean's cabaret application at a planned Wantagh business has been withdrawn.

The motion, which was postponed three times since early July, had been scheduled for Justice Antonio Brandveen’s Wednesday morning calendar. Susan Trenkle-Pokalsky, press secretary for the Town of Hempstead, said they received word Monday about the motion being dropped. 

J. Stewart Moore, Dean's attorney who was handling the motion in Nassau County Supreme Court, could not be reached for comment Tuesday. 

Dean’s suit filed against the Town of Hempstead that Justice Brandveen rejected this past spring argued that the Board of Zoning Appeals (BZA) should have never revoked its original June 2010 approval for cabaret usage on the 3500 Sunrise Hwy. parcel. The suit also pointed out that the property, which Dean acquired in 2009 for $950,000, has had cabaret usage for previously opened bars and restaurants going back to the late 1960s.

Dean's chief legal counsel, zoning attorney William Cohn of Uniondale, has filed an appeal at the State Supreme Court Appellate Division, a process expected to take months. In addition to fighting to open his Wantagh property, Dean is also awaiting a ruling from the Hempstead Town Board of Appeals on a request to renew a cabaret permit at Billy Dean’s Showtime Café in North Bellmore. 

The Hempstead BZA’s rejection of Dean’s cabaret application came in the midst of community protests that mounted against him because of fears he would operate his Wantagh business similar to Billy Dean's Showtime Cafe, which is advertised on its website as "Long Island’s No. 1 strip club." A cabaret license would permit Dean to offer live music, dancing and entertainment, but no topless or nude performers.

Billy Dean’s website provides a link with information that describes the planned Wantagh venue as one that will offer dinner entertainment with audience participation catering to bachelor, bachelorette and birthday parties. Dean described his planned establishment during a May 18, 2011 zoning board hearing as one that would feature “a Las Vegas style feel” with jugglers, knife throwers and dancers.

The NBUFSD BOE has not mentioned cutting bussing in over a year, it is not a part of the 2013-2014Read More budget. The pensions and benefits are not regulated by the BOE it is a state mandate.

Well for starters, why not give candidates 401K's and only pay a proportion of their benefits...HireRead More teachers and adm that actually live in our district...... Has anybody proposed dismantling the high school district......From the way I understand they have tried unsuccessfully to combine, well then how about saving moneu and splitting up the 3 high schools...This was we wont need 2 administrations...... I will try and I will think out of the box!

So Lu Scala never had any children so it might be safe to say you have never been to a PTA meetingRead More or a School Board meeting or a budget presentation so then you would have no idea how the money is spent good or bad. I'm sorry that your neighbors make more than you but like anything else you get what you pay for there are educational requirements for teaching and administration jobs, I'm sure you would be happy if all the school personnel could be replaced by minimum wage earners or better yet we could close all the schools after all you have been out of school for 40 years so you don't need them anymore, but thats not how it works. Why is always the uninformed that speak loudest and longest?

I never had any kids.. and am the last kid who went to to the Bellmore Merrick school system.....itsRead More been almost 40 years since I was a Mempham grad..and it is very disharting to hear that my many many high tax dollars..are not enought for these kids I have been sororting all these years!!! Who is getting all the money??? Its all bull.. aI live inbetween teachers.. how is it they can afford high end cars, housekeepers, landscapers, ect??????... the money is being spent in the WRONG WAYS TO THE TEACHERS, AND MOST OF ALL THE ADMISTRATION, THE SCHOOL BOARD ECT... I AM CALLING FOR A MASSIVE AUDIT AND GET0 per year.. they afe not worth any more then that.. THE MONEY BACK FROM ANYONE WHO WAS PAID MORE THEN $75,00....
