A new suit filed by the Town of Oyster Bay is seeking to shut down a popular South Shore bar.

The suit claims Smuggler Jack's in Massapequa has violated town code by allowing outdoor dining and drinking, improperly using boat slips, and allowing 115 people inside when their limit was 72, according to Newsday. The suit also alleges that the bar encourages higher boating traffic and allows motorboats to idle. The Nassau County Department cited the bar Monday for improper maintenance of garbage and food prepping, said the report.

Smuggler Jack's attorney, Edward Ross, called the Town's allegations "outrageous" but said they are trying to resolve the dispute, said Newsday. While they agreed to cut music and outdoor seating at a certain hour, they reportedly went against the stipulations later on.

I LOVE this place- Popo your right- it is a nice family place with a fun atmosphere- they should worry about many other issues then this--

@Denise Bauer- got to laugh.... You Do realize even when the Forest Inn was OPEN it had NO PATRONS =NO NOISE= no money=which is why it CLOSED...the 90 something yr olds who are barely breathing that patronized the place typically didnt make a heck of a lot of noise, neither btw do cemeteries. If you want total peace and quiet then I suggest you shouldn't have moved in the vincinity of a legaly zoned restaurant ..But wait if you looked at houses a few blocks over they were more expensive!!! WHY??? because there wasn't a legally zoned rest on those blocks. You GOT what you paid for, a house in a neighborhood with a restaurant , at a lower price than house a few blocks away.

btw - I would fully support anyone who complained if they tore down a restaurant/bar and built a Restaurant with skateboard park, a go cart track, an amusement center, or strip club Because you didn't buy a house next to any of those.. you bought a house near a restaurant /bar and that's what it is a restaurant/bar location location location.. let the buyer beware.

the problem is not that they built a nice place in the neighborhood, the problem is that they violating the permits.

Anyone know what permits they're violating? My other question is: Typically it takes a long time and NUMEROUS, NUMEROUS complaints by more than 4-6 people to get ANY town to move on Anything- WHY now, Why the interest in THIS place Why hasn't the Town moved As Expeditiously on the Bar and Rest's on PARK Ave? Those neighbors have been complaining for YEARS! So my question is WHO KNOWS WHO, who has been complaining behind the scenes , calling in favors perhaps over cocktails or on the golf course, and WHY are the honchos at the TOB jumping thru hoops to appease so FEW and for WHOM exactly???
